Fences

Fences - Did You Know?

  • Permits are required for all fencing in the City of Arvada.
  • Fence permits never expire. If you are replacing the fence with same materials and locations that was previously approved on the existing permit and site plan, a new permit is not required.
  • If you are the homeowner and you occupy the structure, you may apply for the permit. If you are hiring a contractor to complete the work, please have them apply for the permit. If this is a rental property and the work is not being completed by the homeowner, the applicant must obtain a Fence Construction Approval, please find the form under Resources. 
  • If you are relocating an existing fence, a new permit and site plan are still required.
  • Fences located on lot lines that are adjacent to public rights-of-ways, including trails, shall have the finished side facing the right-of-way.
  • 6 foot fence is the maximum height for residential fences.
  • Fences in the front yard (front setback) may only be 48 inches tall and must be 65% open.
    • To calculate 65% open space requirement:  Measure the size of the picket and multiply that by 1.86 to determine the space required between pickets.
  • If your property is located in a floodplain, additional permits and fees maybe required by the Engineering Division. All permits within floodplain will be reviewed and you will be contacted if additional permits and fees are due.
  • Fences shall not be erected that block the intersection sight distance triangles
  • Homeowner Association (HOA) may have their own requirements, please reference HOA bylaws for subdivision requirements.

New:  Rental property owners can now install or replace a fence on their property without having to use a licensed contractor.  If a tenant is installing a fence, they need to have the Homeowner Waiver completed.

What You Will Need to Apply

Step 1: Site Plan

Create a site plan with details of the distance to each property line including the address and indicate direction (North, South, East, West). If you do not have a site plan you can check the address files. If there is no site plan you can get an ILC on your property by hiring a 3rd party company or a site plan can be created by you. If you need assistance with your site plan please contact Neighborhood Services at 720-898-7465. A sample site plan is provided in Resources under Application and Guidelines.

Step 2: Determine the zoning for your property

Please use the address tool to see Zoning for your address.  Enter your address, and then click Full Report. Once you find your zoning, use the Setbacks table to find your minimum setback requirements. Identify all of the proposed fence setbacks on the site plan, they must be within the minimum required setbacks.

If your property is located on a corner lot, you will have two front setbacks (two sides that face a street).

Step 3: Complete the Application

Applications can be submitted using our online tool, www.arvadapermits.org. All documents will need to be attached in a .PDF format. Neighborhood Services will complete a zoning compliance review of the site plan and application. Applications are accepted in person at City Hall, 2nd Floor at the Neighborhood Services counter, Monday through Friday 8:00 a.m. to 5:00 p.m.

Step 4: Staff Review

Staff will review the application and attachments. If there is more information that is needed, you will be contact by staff. Once the permit is approved, you will receive an email with the next steps to obtain the permit.

Fees

Fences that are 6 feet and under will be charge a zoning compliance fee and use tax.

Use tax is collected at time of the permit issuance. Once the Use Tax has been paid, a copy of the permit can be presented to the vendor when you purchase your construction materials.

What is Use Tax

Use tax is a tax that is assessed in lieu of sales tax. The Arvada use tax rate is the same as the sales tax rate, 3.46%. Building use tax is assessed on construction materials that are used in Arvada. The revenues from building use tax are utilized to fund additional city services related to construction growth.

The tax is computed on 56% of the total value of the project. The construction project valuation is based on statistical data relating to costs of similar projects or the actual contract price of a project. Although an individual may conduct the construction work themselves and may obtain materials at a discount or no cost to the project still results in increased value to the improvements. Consequently, use tax is calculated on the greater of the calculated or contract values.

Inspections

Neighborhood Services will complete an inspection after completion of the project to ensure that the fence was constructed as it was approved on the permit. An email will be sent to notify the applicant if there are any issues with the install. Inspection results can be viewed anytime at www.arvadapermits.org.
 

Fences over 6 feet

Fences that are over 6 feet will be subject to a plan review completed by the Building Inspection Division. The application must include a site plan, and specifications for the wind rating.
